ICJ Has Audacity To Give Germany Immunity Over WWII Atrocities!

The International Court of Justice (ICJ), which is the principal judicial organ
of the United Nations, on Friday rendered its unjust Judgment in the case
concerning Jurisdictional Immunities of the State (Germany v. Italy:
Greece intervening) and literally had the audacity to give legal immunity to Germany from being sued in foreign courts by victims of World War II Nazi atrocities.

The Court of Justice actually said that Italy’s Supreme Court violated Germany’s sovereignty in 2008 by judging that an Italian civilian, Luigi Ferrini, was entitled to reparations for his deportation to Germany in 1944 to work as a slave laborer in the armaments industry.

The 15-judge world court said in a 12-3 ruling that the Italian case violated Germany’s long-standing immunity, which has been recognized in international law, from being sued in national courts. “The action of Italian courts in denying Germany immunity … constitutes a breach of the obligation owed by the Italian state to Germany,” world court President Hisashi Owada said.

Here is the ruling in detail:

(1) finds, by twelve votes to three, that the Italian Republic has violated its obligation to respect the immunity which the Federal Republic of Germany enjoys under international law by allowing civil claims to be brought against it based on violations of international humanitarian law committed by the German Reich between 1943 and 1945;
(2) finds, by fourteen votes to one, that the Italian Republic has violated its obligation to respect the immunity which the Federal Republic of Germany enjoys under international law by taking measures of constraint against Villa Vigoni;
(3) finds, by fourteen votes to one, that the Italian Republic has violated its obligation to respect the immunity which the Federal Republic of Germany enjoys under international law by declaring enforceable in Italy decisions of Greek courts based on violations of international humanitarian law committed in Greece by the German Reich;
(4) finds, by fourteen votes to one, that the Italian Republic must, by enacting appropriate legislation, or by resorting to other methods of its choosing, ensure that the decisions of its courts and those of other judicial authorities infringing the immunity which the Federal Republic of Germany enjoys under international law cease to have effect;
(5) rejects, unanimously, all other submissions made by the Federal Republic of Germany.

If the international court in the Hague which supposedly stands for justice and human rights can rule in favor of the barbarians of WWII… then be certain that there is no justice in this world and every case that has been debated there is probably fixed and predetermined. Shame on them.
